In a meeting held this Thursday afternoon (11/3), the Board of Directors of the National Telecommunications Agency (Anatel) approved the designation of Non-Geographical Code 0304 for collection activities, in the same way as has already been done for code 0303 The objective is to stop the misuse of numbering resources by certain agents.

In his analysis, the counselor Emmanoel Campelo pointed out that the collection activity is offensive “in equal or greater weight than the telemarketing activity in terms of the volume of short calls in Brazil”.

According to the General Telecommunications Law (LGT), it is up to the Union, through the regulatory body, to discipline and supervise the operation of telecommunications networks. The rapporteur explained that it is up to billing service providers, as users of public telecommunications networks, to correctly use this service, as stipulated in art. 4 of the LGT.

“What is sought is the adoption of responsible conduct by these companies without overloading the networks”, explained the counselor Moisés Moreira. Councilor Arthur Coimbra said that it is regrettable that the indiscriminate use of the telecommunications network causes so much inconvenience to users. Counselor Emmanoel stressed that what is being fought is abusive conduct. “The 0304 code designation is a tool that empowers the telecommunications user regardless of the situation they find themselves in”.

Anatel will carry out a public consultation, for 60 days, to regulate the operational procedure and after the publication of the act by the Agency, companies will have 180 days to implement the measure.

Anatel’s initiatives in the continuous effort to minimize the harmful effects of short-term calls :

Creation of the “Não Me Perturbe” platform ( www.naomeperturbe.com.br ) by telecommunications providers based on Decision No. 3/2019/RCTS/SRC;

Inspection actions on spoofing incidents;

Decision No. 160/2022, on June 6, 2022, to allow blocking of calls that do not use numbering resources assigned by Anatel, whether they originate on the network itself (Switched Fixed Telephone Service – STFC and Personal Mobile Service – SMP), are from other networks coming from interconnection;

Combating spoofing: incorporated in Act No. 13,672, of September 27, 2022;

Decision No. 250, of October 18, 2022, which determined the blocking, for a period of 15 days, of the call origination capacity of the STFC and SMP accesses of legal entities that, in the respective service, generate at least 100,000 (one hundred thousand) short calls by access code in one day; or, generate at least 100,000 (one hundred thousand) calls, in one day, considering the total accesses assigned to the legal entity, and in which the total of short calls represents a proportion equal to or greater than 85% of the total calls; disclosure of the list of the biggest offenders in terms of abusive calls.

Decision No. 160/2022, which had its criteria improved recently, has already brought significant results to the sector, such as the strong reduction in short calls, of up to three seconds, observed between the week of dispatch of the Order (05th to 11th June 2022) and the week of October 2-8, which reduced from about 3.8 billion to 2.8 billion. This means that around 16.3 billion short calls were not made between June and October 2022, which undeniably demonstrates the effectiveness of the measures adopted by this Agency. https://www.bnamericas.com
