Ofcom Proposes To Apply Code Powers, Modify Terms

UK TMT sector regulator Ofcom has made proposals to apply Code powers to 4th Utility Holdings Ltd and modify the terms on which the Code is applied to Community Fibre Limited, Cyber Era NG learns.

Ofcom Friday published a consultation on applying the Electronic Communications Code to 4th Utility Holdings Ltd under section 107(4) of the Communications Act 2003.

The Code is designed to facilitate the installation and maintenance of an electronic communications network, conferring rights which result in simplified planning procedures.

The regulator has also published a consultation on modifying the terms on which the Code is applied to Community Fibre Limited under section 107(6) of the Act.

This follows an application from Community Fibre to extend its current powers beyond inner and greater London within the M25, to the rest of the United Kingdom.

 Both consultations close on March 28 2022.
